FOXBOROUGH, Mass. — The Norfolk County District Attorney has dropped the charges against a pair of Rhode Island men for their involvement in a fight at Gillette Stadium during a Patriots game which resulted in the death of a New Hampshire man.

According to court documents the charges against Justin Mitchell and John Vieira both of Warwick Rhode Island, were dropped “in the interest of justice.”

The decision comes after the pair were charged with assault and battery and disorderly conduct for their roles in the September 2023 altercation with Dale Mooney, of Newmarket after Police say footage showed Mooney, Mitchell, Vieira and a number of other fans got into a verbal altercation which escalated during the game and that Mooney rushed past security and “initiated a physical altercation” with Mitchell and then lost consciousness before being separated by security.

From authorities say the 53-year-old Mooney who suffered from a preexisting heart condition, ended up dying from cardiac issues which occurred following the altercation.
