MANCHESTER, N.H.- The State of New Hampshire has asked a Federal Court of Appeals to pause an order telling it to resume its vehicle inspection and emissions program.

In its appeal the state says the previously issued order telling it to continue the program goes too far and was originally intended to stop economic harm to a third party, with that third party being Gordon-Darby, the company suing the state for violating the Clean Air Act, when in fact it’s actually a private lawsuit.

In the meantime, those who have yet to get a vehicle inspection still won’t have to, after the state suspended inspections across the state altogether, after passing a law which did away with the program.
