MANCHESTER, N.H.- The New Hampshire Supreme Court has overturned the second-degree murder conviction of Adam Montgomery.

Thursday morning the high court issued its decision after Montgomery was found guilty for the death of his 5-year-old daughter Harmony Montgomery back in 2019 and currently serving a sentence of 56 years to life in prison.

According to court documents Thursday’s decision comes after the court heard Montgomery’s appeal in October in which his lawyer argued that Montgomery should have been tried separately on the assault and murder charges and not allowed Harmony’s stepmother Kayla Montgomery to testify nor should allowed the state to show police body camera footage at his trial.

However, while the court ended reversed Montgomery’s second-degree murder conviction it affirmed his convictions for falsifying physical evidence, witness tampering and abuse of a corpse.

Montgomery is currently being held at a correctional facility in Virgina.

The body of Harmony Montgomery has yet to be found.
